Payment of the full balance must be made at completion of the design project. Failure to do so gives Kirsten Lucia Design the right to refuse handover of the full design services.
Failure to pay the full balance at completion or the contract is terminated for any reason, the designer owns the Copyright in all artwork and design files. The designer owns the rights for usage of the artwork for general promotional advertising for the Designer via any social media platforms which may include but not limited to; Facebook, Instagram and Kirsten Lucia Design website.
The Deposit Fee of 50% is not refundable. If in the case you wish to cancel your contract with Kirsten Lucia Design you will do so while forfeiting any monies paid and any artwork previously created will remain withheld until the adequate fees are paid to cover any additional costs.
The client must make every effort to cooperate in order for the Designer to fulfil its contracted design duty. The Designer cannot accept responsibility for the ‘extent’ of the design coverage if details provided are incorrect or if the client choses not to follow the agreed schedule.
Kirsten Lucia Design owns the Copyright in all artwork and design files. Kirsten Lucia Design has permission to use any artwork for industry competitions and as required subsequent usage and for reasonable general promotional advertising for the Designer via any social media platforms which may include but not limited to; Facebook, Instagram and Kirsten Lucia Design website. The usage for any other purpose is to be renegotiated between the parties.
As the Designer owns the Copyright, to copy, cause to be copied or allow anyone else to copy, edit, alter or replicate the artwork is in breach of contract. Artwork is to be used as agreed and they may not be copied or reproduced unless written approval is granted by the Designer.
